Order of the Ministry of Health urging the activation of the Territorial Plan for Civil Protection in the Region of Murcia (PLATEMUR) to deal with the global coronavirus pandemic (COVID-19) (13/03/2020)

By Order of March 12, 2020, of the Ministry of Health, measures were adopted in relation to the global coronavirus pandemic (COVID-19) aimed primarily at protection in cultural and sports events and senior centers, with the objective to guarantee social distancing and avoid the proliferation of contacts with sick and vulnerable people.

Subsequently, by joint order of the Ministry of Health and the Ministry of Education and Culture, it was agreed to temporarily suspend face-to-face educational activity in all centers and stages, cycles, grades, courses and levels of education.

The current epidemic situation requires extreme precautions to avoid massive contagion, seeking maximum social distancing not only in training, cultural or sports centers, but also in the usual places of leisure where close contact occurs between people, such as discotheques. , restaurants, bars and other closed recreational establishments.

Extraordinary measures must be taken to curb transmission and prevent breakdowns in the health care system.

The scope of these measures implies the need to activate for the area of ​​the Region of Murcia the instruments contemplated in Law 17/2015, of July 9, on the National Civil Protection System and specifically the Territorial Plan for Civil Protection of the Murcia Region (PLATEMUR), which will ensure the application of sanitary measures and assist citizens with all operational and logistical resources for civil emergencies.

Article twenty-six 1. of the General Health Law 14/1986, of April 25 establishes that “in the event that there is or is reasonably suspected the existence of an imminent and extraordinary risk to health, the health authorities shall adopt the measures preventives that they deem pertinent, such as the seizure or immobilization of products, suspension of the exercise of activities, closings of companies or their facilities, intervention of material and personal means and any others considered sanitary justification â€.

Organic Law 3/1986, of April 14, on Special Measures in the Field of Public Health, in its third article provides that “in order to control communicable diseases, the health authority, in addition to carrying out general preventive actions, may adopt the appropriate measures for the control of the patients, of the people who are or have been in contact with them and of the immediate environment, as well as those deemed necessary in the event of a transmissible risk.

For its part, article 54 of Law 33/2011, of October 4, General Public Health provides that without prejudice to the measures provided for in Organic Law 3/1986, of April 14, on Special Measures in the Matter of Public Health, as an exception and when it is required by reasons of extraordinary gravity or urgency, the General State Administration and those of the autonomous communities and cities of Ceuta and Melilla, within the scope of their respective powers, may adopt as many measures as necessary to ensure compliance with the law, including the suspension of activities.

According to article 6.j of Law 4/1994, of July 26, Health of the Region of Murcia, corresponds to the Ministry responsible for health "Exercise the sanctioning powers and public intervention for the protection of health. â€

In accordance with the provisions of article 11.1 of the Statute of Autonomy of the Autonomous Community of the Region of Murcia, approved by Organic Law 4/1982, of June 9, it has been attributed competence for legislative development and execution in matters of health, hygiene, pharmaceutical organization and hospital coordination in general, including that of Social Security, without prejudice to the provisions of number 16 of article 149.1 of the Constitution.

In article 11 of the President's Decree No. 29/2019, of July 31, reorganization of the Regional Administration, it is provided that the Ministry of Health is the Department of the Autonomous Community of the Region of Murcia in charge of the proposal , development and execution of the general guidelines of the Governing Council in the following matters: health, hygiene, pharmaceutical ordering, general hospital coordination, including that of Social Security;

drug dependence;

the powers of execution in matters of pharmaceutical products and management of health care that the Autonomous Community of the Region of Murcia has legally attributed, and any others assigned by current legislation.

For all this, by virtue of the powers conferred on me in the field of Public Health, consulted the competent units in epidemiology and health surveillance in relation to the urgency and need for measures, on the proposal of the General Directorate of Public Health and Addictions and taking into account the provisions of Law 17/2015, of July 9, on the National Civil Protection System:

I have:

First.

Given the evolution in the regional territory of the existing health emergency due to the global coronavirus pandemic (COVID-19) and the need to contain the transmission of the disease, the activation of the Territorial Plan for Civil Protection in the Region of Murcia is urged ( PLATEMUR).

Second.

To guarantee the reduction of contacts and massive contagion, the following measures are adopted:

- Closing of cinemas, discotheques, restaurants, bars and other similar recreational and leisure establishments.

- Closing of shops and shopping centers, with the exception of establishments that provide basic necessities, including as such, in any case, food, health and pharmaceutical products.

- Closing of parks, gardens and beaches.

- Confinement measures that restrict the freedom of movement of people, allowing displacement exclusively for work, medical-assistance reasons and the acquisition of basic necessities, health and pharmaceutical products.

Initially, these measures will reach the municipalities of Cartagena, San Javier, San Pedro, Mazarrón, Águilas, Los Alcázares and La Unión, notwithstanding that they can be extended to other municipalities in the regional territory.

Third.

The execution, monitoring and control of the measures adopted in the previous point will be made within the framework of the Territorial Plan for Civil Protection of the Region of Murcia (PLATEMUR)

Room.

Through the appropriate regulatory channel, the judicial ratification of the measures contemplated in accordance with the provisions of article 8.6 of the Administrative Litigation Jurisdiction Law will be requested.

Fifth.

This Order will enter into force on the same day of its publication in the Official Gazette of the Region of Murcia.
